1. Acceptance of Terms:

 

By accessing, purchasing from, or reselling products supplied by PWD International, you (“Customer,” “Buyer,” or “Reseller”) agree to be bound by these Terms & Conditions. If you do not agree, you may not purchase, distribute, or resell any products supplied by PWD International.

 

2. Nature of Products:

 

PWD International distributes industrial, commercial, and specialty cleaning solvents intended solely for legitimate cleaning and commercial applications.

 

All products, including those marketed under the Rush® brand and related brands, are:

• Not intended for human consumption

• Not intended for inhalation

• Not intended for medical, therapeutic, or recreational use

 

No product sold by PWD International is marketed, labeled, or authorized as a drug, dietary supplement, or consumer inhalant.

 

3. FDA Compliance & Regulatory Position:

 

PWD International operates as a wholesale distributor of cleaning solvents, not as a manufacturer of drugs or medical products.

• Products are not FDA-approved for ingestion, inhalation, or bodily use

• Any implication, suggestion, or representation that products are intended for such uses is strictly prohibited

• Resellers must comply with all applicable FDA, FTC, state, and international regulations

 

PWD International does not make, and expressly disclaims, any claims regarding physiological, therapeutic, or recreational effects.

 

4. Proper Resale & Marketing Requirements:

 

]Customers and resellers must adhere to the following requirements:

 

Prohibited Actions:

 

Resellers may not:

​

• Market or advertise products as “poppers”

• Suggest inhalation, ingestion, or bodily use

• Reference euphoric, sexual, or physiological effects

• Use slang, imagery, or terminology implying recreational use

• Sell products in jurisdictions where prohibited by law

 

Required Practices:

 

Resellers must:

​

• Market products strictly as cleaning solvents

• Use compliant product descriptions consistent with PWD International guidance

• Maintain appropriate disclaimers on websites and listings

• Verify age requirements and applicable local laws

• Comply with all labeling, shipping, and storage regulations

 

Failure to comply may result in immediate termination of supply.

 

5. Assumption of Risk & Indemnification:

 

The Buyer assumes all responsibility for:

• Proper storage, handling, labeling, and resale

• Compliance with federal, state, and international laws

• Customer education and lawful distribution

 

Buyer agrees to indemnify, defend, and hold harmless PWD International, its owners, officers, affiliates, and suppliers from any claims, damages, losses, regulatory actions, fines, or liabilities arising from:

• Improper marketing or misuse

• Regulatory violations

• Consumer misuse after resale

• Non-compliant advertising or representations

 

6. Limitation of Liability:

 

PWD International shall not be liable for:

​

• Indirect, incidental, or consequential damages

• Lost profits or business interruption

• Third-party misuse or misrepresentation

• Regulatory enforcement actions arising from reseller conduct

 

Products are sold “AS IS” and “AS AVAILABLE”, without warranties beyond those required by law.

 

7. Right to Refuse or Terminate Supply:

 

PWD International reserves the right to:

​

• Refuse service to any customer

• Suspend or terminate accounts without notice

• Request proof of compliant resale practices

• Deny sales where regulatory risk is identified

 

8. Jurisdiction & Governing Law:

 

These Terms & Conditions shall be governed by and construed in accordance with the laws of the applicable jurisdiction in which PWD International operates, without regard to conflict-of-law principles.

 

9. Modifications:

 

PWD International reserves the right to update or modify these Terms & Conditions at any time. Continued purchasing or resale constitutes acceptance of any revisions.
